Liability Waiver & Release Agreement
This Liability Waiver and Release Agreement (the “Agreement”) is entered into between Body Form Lab Inc. operating as Body Form Pilates (hereinafter referred to as the “Studio”) and the undersigned client (hereinafter referred to as the “Client”). By signing this Agreement, the Client acknowledges that they have voluntarily chosen to participate in activities, classes, or sessions provided by the Studio.
Notification of cancellation must be provided at least 24 hours in advance of a scheduled class to avoid a charge. Failure to cancel within this period will result in a $12 fee. This policy ensures efficient scheduling and fairness for all clients. Cancellations may be made by email, phone, or through the Studio’s booking system.
The Client represents and warrants that they are in good physical condition and have no medical condition that would prevent safe participation in Pilates or fitness activities. The Studio has not made any medical claims or prescribed medical treatment. The Client has been advised to consult a physician prior to beginning any exercise program and agrees to inform the Studio immediately of any pain, discomfort, or adverse symptoms during participation.
The Client acknowledges that participation in Pilates, yoga, stretching, and fitness programs involves inherent risks, including but not limited to: muscle strain, sprain, overexertion, slips or falls, back or neck injury, or equipment malfunction. The Client voluntarily assumes all such risks, both known and unknown, even if arising from the negligence of the Studio or its instructors, to the fullest extent permitted by law.
Release & Waiver of Liability
The Client hereby fully and forever releases, waives, discharges, and holds harmless Body Form Lab Inc. operating as Body Form Pilates, its owners, directors, instructors, employees, agents, contractors, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, causes of action, or liabilities for personal injury, property damage, or wrongful death arising from participation in activities at the Studio, whether caused by ordinary negligence of the Released Parties or otherwise, to the fullest extent permitted bylaw. This waiver does not apply to acts of gross negligence or wilful misconduct as prohibited by Ontario law.
The Client agrees to indemnify and hold harmless the Released Parties from any and all claims, demands, or actions, including legal fees, arising out of or related to participation in any Studio activities or use of Studio facilities or equipment.
Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties hereby submit to the exclusive jurisdiction of the courts of Ontario.
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement constitutes the entire understanding between the parties and supersedes all prior representations or agreements.
